Georgia, seat (1853) of Dougherty county, southwestern Georgia, U.S. It lies along the Flint River at the head of navigation, about 90 miles (145 km) southeast of Columbus. Cotton growing declined in the Albany area after a serious boll weevil infestation in 1915. Do I need a lawyer for a DUI?
Whether or not an attorney is necessary after you've been charged with DUI depends on a number of factors.
When considering your DUI case, a lawyer will ask you things like: Is this your first DUI, or one of many? What was your blood-alcohol content (BAC)? Did your DUI arrest occur as a result of an accident? Was anybody injured? And how much are you able to spend on legal representation in light of what you have to lose?
First-time DUI offense
You might be in a position to pursue self-representation if you are a first-time offender with a clean criminal background, over-the-line but relatively low BAC results, and a willingness to complete the actions necessary to reduce or avoid the charges.
From a judge's and prosecutor's perspective, these offenses are highly routine and are handled in a similar manner to a traffic offense. Additionally, spending up to $5,000 for an attorney to walk you through the administrative and bureaucratic process of a first DUI may not be a necessary expense.
However, if you suspect any sort of misconduct, mishandling of blood samples, or other possible defense to your DUI charge, it may be in your best interests to retain an attorney to gather information, file a motion to dismiss evidence, or simply argue on your behalf against the charges. While the consequences of a first-time DUI are not necessarily devastating, it may be worth it to hire a lawyer if there is a possibility for total dismissal.
Repeat offenders and high BAC results
Under the law of most jurisdictions, certain aggravating factors can turn an ordinary DUI charge into a major criminal offense--resulting in significant fines, penalties, and even jail time. Two of the most common aggravating factors are subsequent offenses and a very high BAC reading.
